„Virtual Event and Ticketing Platform“ der Broadcast Fabrik – Stand: 15.10.2020
Bei der Erstellung eines Nutzerkontos auf der „Virtual Event and Ticketing Platform“ stimmt der Nutzer ausdrücklich der Geltung der folgenden Bedingungen für die Nutzung der Plattform zu. Die Nutzungsbedingungen regeln das Nutzungsverhältnis zwischen der Broadcast Fabrik (eine Marke der bitkomplex UG (haftungsbeschränkt, Reinhardtstraße 12, 10117 Berlin) und dem Nutzer. Das Vertragsverhältnis zwischen dem Nutzer und dem Veranstalter bleibt davon unberührt.
Nach Registrierung und Einverständniserklärung mit der Nutzungsvereinbarung erhält der Nutzer ein Nutzerkonto auf der Event-Plattform der Broadcast Fabrik, mit dem Tickets für virtuelle Events von Dritten Erworben werden können und mit dem die virtuelle Teilnahme an selbigen ermöglicht wird. Die Broadcast Fabrik stellt dabei nur die Plattform (technische Infrastruktur) im Auftrag des Veranstalters zur Verfügung und wird zu keiner Zeit Teil des Vertragsverhältnis zwischen Nutzer und Veranstalter.
Nutzerkonten sind personalisiert und dienen ausschließlich der persönlichen Nutzung. Die Weitergabe eines Nutzerkontos ist nicht gestattet. Die Broadcast Fabrik hat zur Sicherung technische Maßnahmen ergriffen, die ein mehrmaliges Einloggen in den gleichen Account verhindern.
Der Nutzer erklärt ferner, dass er die Plattform nur im Einklang mit dieser Nutzungsvereinbarung und den von den Veranstaltern gestellten Allgemeinen Geschäftsbedingungen. Insbesondere unterlässt der Nutzer jeden Versuch, die Sicherungsmechanismen der Eventpage zu umgehen oder die Inhalte anderweitig für Nicht-Berechtigte verfügbar zu machen.
Die Broadcast Fabrik und der Nutzer einigen sich schon jetzt darauf, dass jeder Versuch, ob erfolgreich oder nicht, eine pauschale Schadensersatzforderung der Broadcast Fabrik von bis zu 50.000 € (in Worten „fünfzigtausend“), aber mindestens 1.000 EUR (in Worten „eintausend“) gegen den Nutzer begründet. Die Festsetzung der Höhe der Forderung liegt im billigen Ermessen der Broadcast Fabrik. Bei der Ausübung des billigen Ermessens zieht die Broadcast Fabrik folgende Überlegungen mit ein:
- die zur schaugestellten kriminellen Energie des Nutzers
- die Verwerflichkeit der Motivation des Nutzers und
- entstandene Reputationsschäden für die Broadcast Fabrik.
Bemerkt die Broadcast Fabrik Versuche die Sicherheitsmechanismen und/oder eine missbräuchliche Verwendung des Nutzerkontos oder besteht ein entsprechender begründete Verdacht, ist die Broadcast Fabrik berechtigt den entsprechenden Account zu deaktivieren und nach bestätigtem Verdacht den Account unwiederbringlich zu löschen. Der Nutzer hat bei berechtigter Löschung keinen Anspruch gegenüber der Broadcast Fabrik auf Rückerstattung des an den Veranstalter gezahlten Ticketpreis oder sonstigen Schadensersatzes.
„Virtual Event and Ticketing Platform“ of the Broadcast Factory – Status: 15.10.2020
With the creation of a user account on the „Virtual Event and Ticketing Platform“ the user expressly agrees to the validity of the following terms of use. The terms of use govern the relationship between the Broadcast Fabrik (a brand of the bitkomplex UG (limited liability, Reinhardtstraße 12, 10117 Berlin) and the user. The contractual relationship between the user and the Event-Hosts remain unaffected.
After registration and agreeing to terms of use, the user receives a user account on the event. platform by Broadcast Fabrik, with which allows the user to purchase tickets for virtual events offered by third parties and with which the virtual participation in the those events is made possible.
Broadcast Fabrik is only the provider of the technical infrastructure and works on behalf of the event organizer. Broadcast Fabrik will at no time become part of the event organizer or enter into contractual relationship with the user besides these terms of use.
User accounts are personalized and shall only be used by the account owner and not passed on at anytime. The transfer of a user account is not permitted. Broadcast Fabrik has implemented technical measures to ensure the non-transferability and prevent multiple logins to the same account.
The User declares that he will only use the platform in accordance with the terms of use and the terms and conditions of the event organizer. In particular the user agrees not to attempt or circumvent any security mechanisms of the event page or otherwise make the content available to unauthorized persons.
Broadcast Fabrik and the user already agree that any such attempt, whether successful or not, leads to a contractual penalty of up to 50.000 € (in words „fifty thousand“), but at least 1,000 EUR (in words „one thousand“) against the user. The determination the amount of the claim is at the reasonable discretion of Broadcast Factory. In exercising its equitable discretion, Broadcast Fabrik will include the following considerations:
- the displayed criminal energy of the user
- the reprehensibility of the user’s motivation and
- the created repetitional damage for the Broadcast Factory.
Broadcast Fabrik is authorized to deactivate the use account if there reasonable suspicious of misuse of the user account until further investigations. In case the investigations confirm the misuse the account will be irretrievably deleted and the accountholder banned from the platform. In case of justified deletion, the user has no claim against the Broadcast Factory for reimbursement of the amount paid to the organizer paid ticket price or other compensation.
